iLink You is a platform for content sharing that empowers creators to link their audience with their most updated and relevant material. One of our fundamental principles is to embrace intentional simplicity — therefore, we've endeavored to condense our terms and conditions into their most straightforward and comprehensible format.
We're thrilled to welcome you aboard. The Terms presented here, along with the policies we've linked, are the rules that oversee your interaction with our services – this includes our website (for example, https://ilink-you.com/, applications, and any associated software or features, collectively known as the “Platform” or “iLink You.”
In these Terms, when we mention “we,” “our,” or “us,” we're referring to iLink You LLC (for instance, with a hypothetical registration number) and our affiliated entities. By engaging with iLink You, you're consenting to these Terms & Conditions (“Terms”) and the additional policies referenced both here and on the Platform. We encourage you to carefully review these Terms, and don't hesitate to reach out with any inquiries. If these Terms don't align with your expectations, we respectfully ask that you refrain from using iLink You.
iLink You is an ever-evolving platform, continually enhancing its features and functionalities. As a result, we may occasionally update the Platform or these Terms. These updates may be necessary to mirror changes in our business, the Platform (including the potential removal of certain features or aspects of the Platform), legal or commercial requirements, or to safeguard our legitimate interests. We reserve the right to implement these updates at any time, and it falls under your responsibility to periodically review these Terms for any such modifications.
In the event of a significant change that may negatively impact you, we are committed to making every reasonable effort to inform you at least one month prior to the change's implementation (for example, via a notification on the Platform). Your ongoing use of the Platform following any amendments to the Terms signifies your acceptance of these updated Terms. If you disagree with the modifications, we respectfully request that you discontinue using iLink You and deactivate your account.
To set up an account and join the iLink You community, you need to be 18 years or older. If you're establishing an account for another individual, it's essential to have their explicit consent. The responsibility for the use and management of your account falls solely on you, and it's imperative to use it in compliance with the law. By registering an account, you're agreeing to abide by these Terms, confirming you are over 18, and legally capable of entering into these Terms with us. It's important to provide us with correct personal information, and keep us informed of any changes to ensure your details remain current.
Should you be using iLink You on behalf of a company or another person, you must verify that you are duly authorized to accept these Terms on their behalf. You are accountable for all activities under your account, so safeguarding your login credentials and keeping your password confidential is crucial.
In case you suspect any security breach or unauthorized use of your account, it's imperative to contact us without delay. You are prohibited from transferring or assigning your account to others, or using it (or allowing its use) in a manner that, in our reasonable judgment, could harm iLink You's standing, violate the rights of others, or breach any laws or regulations.
In the process of creating your iLink You profile, selecting an appropriate username is crucial. While we acknowledge the personal significance of your username, it's essential that it respects all users and does not infringe upon anyone's rights, including intellectual property (IP) rights such as copyright and trademarks. Avoid using names that belong to public figures or brands, and steer clear of usernames that are offensive, crude, or chosen solely for potential future profit (an act known as “Domain Squatting”).
Should any issues arise concerning your username, we will evaluate the situation impartially and might request you to alter it (it could be reassigned as well). Refusal to comply may lead to the suspension or termination of your account. In instances where your username is alleged to violate someone else's IP rights, they must submit an Intellectual Property report. You will then have an opportunity to counter with a Notice. Moreover, if your account shows no login activity, new links, or traffic for over six months, we reserve the right to reclaim or reassign your username, though we will attempt to contact you beforehand.
At iLink You, we're enthusiastic about the diverse content our users share! But, it's our priority to ensure a safe experience for everyone on the Platform, which is why we've established Community Standards. These guidelines define what is acceptable and what isn't on iLink You. It's crucial to adhere to these standards; failure to do so could result in the suspension or permanent removal of your account.
The term “content” refers to the text, images, videos, links, and all other materials you upload to your iLink You profile. You bear full responsibility for your content, and you assure that:
Given that legal standards vary worldwide, we may prohibit content deemed legal in some areas but not in others. We reserve the right to take necessary actions to maintain the safety of iLink You, including removing content or restricting access.
We value your content greatly and aim to showcase it prominently. By posting content on your iLink You profile, you're providing us a license to (i) utilize, publicly exhibit, distribute, alter, adapt, and create derivative works from your content; and (ii) employ your name, image, voice, photograph, likeness, and any other personal traits included in the content; both on the Platform and in our marketing activities across all media (like our social media channels and other forms of advertising). This license is global, royalty-free, and perpetual, allowing us to use your content worldwide, without any fees, indefinitely. You confirm that you possess all necessary third-party rights to upload the content on iLink You and to grant us this license.
You maintain all your rights to your content. Remember, your content will be publicly available and may be used and redistributed by others on iLink You and throughout the internet.
Please be cautious about sharing personal information on iLink You that you wouldn't want publicly visible. Avoid posting sensitive details like social security numbers, passport information, or other data that could be harmful if misused. You may only share someone else's personal information with their consent and proper documentation of such consent. We're not obliged to monitor the accuracy, reliability, or legality of your content, but we reserve the right to do so.
We may alter, remove, or limit access to content at any time according to these Terms, or place a sensitive content warning on material that we consider inappropriate for all viewers
If you fail to adhere to these Terms, we may be compelled to suspend or terminate your account, take alternative actions regarding your account, or modify your access to the Platform. For instance, if you're late on your fee payments, we might need to downgrade your subscription from a paid to a free plan, which offers limited features.
The action we take will be based on the severity and nature of the breach. There might be instances where suspension or cancellation of your account isn't necessary. However, in cases of repeated or serious violations, such measures are more likely to be employed. If we do decide to suspend or terminate your account, we generally intend to inform you in advance, though we are not legally required to do so.
Please note that you won't be entitled to a refund for any prepaid fees.
If you believe your account was wrongly terminated or if you have any disputes regarding these Terms or the Platform, please contact us at support@ilink-you.com. We are dedicated to resolving issues in good faith and agree to avoid initiating legal proceedings until at least one month of mutual efforts to resolve the issue has been made.
You hold responsibility for the visitors to your iLink You profile, including those who purchase products or services via your page – these are your “End Users.” It is entirely up to you to manage (i) the way End Users interact with your profile and its content, and (ii) ensure that all activities involving your End Users adhere to relevant laws, especially concerning transactions made through your iLink You profile (for example, using features like “Commerce” or “Payment Lock”).
Furthermore, you must recognize that any contributions received via our “Support Me” option are made voluntarily by donors without the anticipation of receiving any goods or services in return. This feature is intended solely for personal donations and should not be used for fundraising for charities or other external causes.
We greatly value your suggestions on how to enhance iLink You! Occasionally, we might introduce “beta” features to you and invite your insights on them. Please be aware that when you offer feedback, we have the liberty to utilize it in any manner we choose, without any obligation for compensation to you (or we might choose not to use it at all). From time to time, we may release certain functions of the Platform in a “beta” version (or similar) for you to try.
You acknowledge that the beta features we provide are still under evaluation and testing. As such, these beta functionalities might not be as reliable or stable as other established parts of the Platform.
As the proprietors of iLink You, we give you a restricted license to use our Platform for content sharing and engaging with other users' content. It's important to note that we are not liable for any content, products, or services offered through other users' profiles. All rights, including Intellectual Property (IP) Rights, related to the Platform (excluding your content) (hereinafter referred to as “iLink You IP”), are solely owned by iLink You or our licensors. You do not gain any rights in the iLink You IP and are prohibited from using it, including our brand name or logo, for any purposes without our express written consent, such as suggesting a partnership or endorsement by iLink You.
As a user, we grant you a limited, revocable, non-exclusive, and non-transferable right to utilize the Platform for creating, displaying, using, playing, and uploading content in line with these Terms.
If we provide you with images, icons, themes, fonts, videos, graphics, or other content, they should be used only on your profile and according to our guidelines. Please avoid removing, hiding, or altering any proprietary notices or trademarks on the Platform. Actions like copying, reproducing, distributing, licensing, selling, reselling, modifying, translating, disassembling, decompiling, decrypting, reverse-engineering, or trying to derive the source code of the Platform or any part thereof are strictly forbidden.
When you access iLink You profiles as a “profile visitor,” we grant you a limited, non-exclusive, and non-transferable right to view and interact with the Platform via user profiles. To the extent permissible by law, we are not accountable for any opinions, advice, statements, products, services, offers, or other content posted by other users on their profiles.
If you opt for a premium plan on iLink You, timely payment of subscription fees is essential. These fees are generally charged in USD and include relevant transaction taxes like GST/VAT, unless stated otherwise. Fees are billed in advance on a recurring basis, based on your choice of a monthly or annual billing cycle. Your subscription will automatically renew at the end of each cycle under the then-current Terms, unless you choose to cancel. When subscribing, provide accurate billing information and a valid payment method (such as a credit card) to enable us to process the fees. In case automatic billing fails, we will send you an online invoice, which must be paid within the designated period.
For transactions conducted via your profile using features like “Request Link” or “Support Me,” a certain percentage of transaction fee may be applicable. These fees depend on your selected plan and are detailed on our pricing page. If applicable, these fees will be subtracted from the transaction amount before being credited to you. Remember, you are responsible for any external fees, taxes (including withholding taxes), and income taxes associated with payments received through the Platform.
Transactions on iLink You are processed by external services like PayPal, Stripe, and Square, each imposing a processing fee. Each payment processor has its own fees, terms, and conditions that you should review and comply with. These processing fees are taken from the transaction amount before you receive it. It’s important to note that iLink You is not responsible for these specific fees.
We reserve the right to modify subscription or transaction fees from time to time. Should there be any changes, we will provide advance notice, usually at least one month before implementation. If you disagree with the revised fees, you have the option to cancel your plan before the commencement of the next billing cycle.
At iLink You, the privacy of both you and your Profile Visitors is a top concern. Our Privacy Notice details our practices in managing your personal data for internal use. Furthermore, our Data Processing Addendum (DPA), accessible in our Trust Center and incorporated into these Terms, outlines both your and our responsibilities regarding the privacy rights of those visiting your profile. By setting up your account, you acknowledge that if the DPA is applicable to you, you have read, understood, and agreed to its terms. For information on how we use cookies, please refer to our Cookie Notice.
All data, along with any intellectual property rights linked to it, generated by either us or the Platform through your use (or that of profile visitors or other users) of the Platform or content (“Data”), will be owned by iLink You. As part of our services on the Platform, we may provide you with access to this Data or its visual representations, which we call “Data Analytics.” While we strive for accuracy and completeness in Data Analytics, we cannot guarantee their precision or entirety.
Occasionally, we might disclose to you information that is considered confidential, such as details about new features, especially if you participate in beta testing with us. Should we share any confidential information regarding iLink You or the Platform, you are obligated to keep this information private and secure. It's also your responsibility to take reasonable steps to prevent unauthorized access to this confidential information.
We emphasize that we bear no responsibility for your usage of the Platform and strongly advise you to keep backups of your content. We are not accountable for any damages that may result from activities like downloading, installing, using the Platform, or copying, distributing, or downloading content from it. It's your duty to ensure that your data, content, and devices are adequately protected and backed up when utilizing the Platform.
By agreeing to these Terms, you commit to indemnify us against any losses that may occur due to your violation of these Terms or if a third party brings a claim against us concerning your content. Neither party will be responsible for indirect, punitive, special, incidental, or consequential damages. This includes, but is not limited to, losses in business, revenue, profits, privacy, data, goodwill, or other financial advantages. This stipulation applies regardless of whether the cause is a breach of contract, negligence, or another factor, even if we were previously informed of the possibility of such damages.
Our liability to you under these Terms or in relation to the Platform shall not exceed the larger amount of the fees you have paid to us in the 12 months preceding the emergence of the liability, or $100.
We need to highlight some critical disclaimers within these terms. Your use of iLink You and any engagement with content on the Platform is entirely at your own risk. iLink You integrates and interacts with various third-party products and services. Within our Platform, we might offer access to certain third-party functionalities or services, such as payment gateways or online shopping features. It's important to note that unless explicitly stated, we neither endorse nor provide warranties regarding these third-party products or services, and we do not issue refunds for transactions made through third parties. Our application incorporates various open source software components, each subject to its unique license terms.
